All Association business is conducted by the Board and Management. Board meetings are held monthly via video call, and all Members and residents are encouraged to attend. Meeting dates and times are posted on the bulletin boards near the pool and mailboxes, and are also shared via email.
The ownership of all exterior areas is jointly shared in common by the Members of the Association, which has been established to maintain the property. The following rules apply to the Common Area
Members are responsible for any damage to Association property caused by themselves, their families, guests, invitees, employees, contractors, tenants, as well as guests, invitees, employees of their tenants.
Common Area equipment (e.g., time clocks, watering systems including valves, lights, etc.) is to be adjusted and set by Association-authorized personnel only. Members may not construct, repair, or maintain any part of the Common Area on their own authority.
Penetration, modification, or alteration of stucco or wood building surfaces or any roof or exterior wall is prohibited. Cutting or drilling holes or driving nails, screws, staples, bolts, or similar items into any of those elements of the Common Area is a violation of this rule.
No exposed trash containers, garden hoses, wood piles, storage containers or packing cartons are permitted in any part of the Common Area.
The construction of fences and walls or the placement of paths and landscaping in the common area is prohibited.
No signs of any description shall be placed or affixed to any common area, including garages or walls, except that "OPEN HOUSE" signs may be staked in the common area from sunrise to sunset on Saturday and Sunday.
The Separate Interest of each Member is limited to the area bounded by the interior walls, floors, ceilings, windows and doors and any area to which the Member has exclusive righto Each Member is responsible for the maintenance of the glass doors and windows enclosing the Member's unit, including the screens, metal frames and tracks of glass doors and windows, the interior of the unit, all appliances whether "built-in n or free-standing within the unit, and all plumbing, electrical and heating systems, lines and pipes, etc., servicing the unit and located within or without the outside perimeter of the exterior bearing walls thereof, including television cable equipment and connections, so long as these systems are used exclusively by the owner and not in common.
No modifications, alterations, or additions visible from any point on the exterior of the units (including inaccessible points) may be made unless approved by the Association, including but not limited to:
Windows and exterior doors, including deck, balcony, patio, garage, and screen doors;
Air conditioning units installed on the exterior of the unit or protruding through the walls or roof;
Rain gutters;
Deck and patio covers;
Exterior painting;
Solar collectors;
Satellite dishes or other antennas;
Garage door keypad
A form for an application by a Member of the Association for approval is available from and submitted to the Manager. The application will require detailed plans and specifications including descriptions of materials and finishes and may require notice to and the consent of the Member's immediate neighbors.
The Manager will present the Member's application to the Association for consideration at the next regularly scheduled meeting of the Board.
The Association's decision to approve or deny the Member's application will be in writing and made in good faith and not be unreasonable, arbitrary, or capricious.
The Association will not approve applications that seek approval of modifications inconsistent with the governing documents of the Association (unless the change is required by law) or violate any governing provision of law, a building code or other applicable law governing land use or public safety.
If a proposed change is disapproved, the written decision shall include an explanation.
Notice of the Association's decision to approve or deny the Member's application will be delivered to the Member no less than ninety days following the Manager's receipt of the Member's application.
Modifications made in violation of these Rules are subject to remediation at the Member's expense.
No Member may convert a garage in any manner that prevents its use for vehicular parking as intended when constructed.
No commercial signs, posters, flags, or banners and no noncommercial signs or posters that are more than nine square feet in size or noncommercial flags or banners that are more than 15 square feet in size may be displayed in a manner that makes them visible from any point on the exterior of the units (including inaccessible points). Notwithstanding the previous sentence, one "FOR SALE", "FOR LEASE" and/or "FOR RENT" sign, not to exceed 18" X 24" in size, may be' displayed from each side of a unit so that it is visible from outside the unit.
Members may lease their Separate Interest, however, not for transient or hotel purposes. Any lease by a Member of the Member's Separate Interest must be for a period of one month or longer, be in writing, and include a clause binding the tenant to the Governing Documents of the Association and providing that failure to comply with them shall be considered an event of default under the lease. Use of a Member's Separate Interest as a vacation rental or similar use not in conformance with this Rule is prohibited.
The Manager maintains a Member Registry with the identity of each Member, their emergency contact information, the identity of the resident(s) of their unit and the residents' vehicle and emergency contact information. The Association does not permit Members, residents, or other members of the public to access the Manager's Member Registry. The Manager keeps this registry solely for the protection and security of the property and safety of the Members and residents in the event of an emergency. The Association will impose a penalty if the Manager is unable to contact the resident or Member in an emergency due to the responsible Member's failure to maintain current information in the Manager's Member Registry
Non-resident Members assign the right to use the Recreation Area to their tenants when their unit is leased
Members are responsible for any violations of the Governing Documents, including the Rules and Regulations in this Information Book, committed by their families, guests, invitees, employees, contractors, tenants, as well as guests, invitees, employees of their tenants. Members should deliver copies of this Information Book to their tenants and incorporate its terms by reference in any lease.
